Better terms for brand deals

CGA just dropped something every creator should add to their contracts.

I’m on the Advisory Board of the Creators Guild of America (CGA), and had a small hand in putting together something that could have monumental impact to the Creator Economy:

This rider was announced last Thursday, and is basically a two-page document you can add on to your brand deals that provides reasonable standardized floors on the following terms:

  • Payment timeline

  • Content ownership

  • Name, image, likeness usage

  • AI training

  • Number of revisions

  • Speed of approvals

  • Crediting for work done

  • Access to the brand’s performance metrics

  • Clear termination rights

  • Legal stuff like indemnities and dispute resolution

  • Much much more!

When I say “floor”, I mean that it’s the minimum the brand agrees to no matter what; you can still negotiate better terms wherever possible while the rest is set at the minimum.

So, for example, IIRC the minimum payment timeline in the rider is “net 90” - so you must get paid within 90 days of completing services. That said, you can always negotiate better terms - like “Net 30” payment within 30 days - while still maintaining the other rider protections like content ownership and a maximum of two (2) rounds of conceptual revisions.

Now, you may be thinking - this is cool, but what if the brand says “No thanks?”

Two thoughts on that:

  1. A bunch of big influencer marketing agencies and brands have already signed on to the rider, including Creator.co, Whalar, Linktree, Beacons, Collab, Influencer, Influencer Marketing Factory, Creator Society, Triller, One Hundred, and Lumanu. Those companies all work with a ton of brands, big and small, so their participation means a huge chunk of the Creator Economy already accepts the rider.

  2. Any brand that refuses to accept the rider is screwing you. We designed this rider in collaboration with talent managers, brand marketers, and lawyers to make sure it is reasonable for everyone. In my humble opinion, any company that refuses to sign on to these minimum terms is planning to take advantage of you, and you should be wary of working with them.
